Welcome to House by Intent. These Terms of Service ("Terms") govern your access to and use of the housebyintent.com website and all related content, features, and services (collectively, the "Service"). By accessing or using House by Intent, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms
By accessing housebyintent.com, creating an account, subscribing to our newsletter, or otherwise using any part of our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and House by Intent, operated by Blake Donovan through Donovan Smart Living.

2. Description of Service
House by Intent is a smart home design blog that provides educational content, insights, and integration logic based on whole-house system thinking. Our content is drawn from over 200 Los Angeles projects and focuses on smart home integration principles rather than gadget reviews. The Service includes articles, design guides, case studies, commentary, and other educational materials related to smart home design and implementation.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. House by Intent shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
3. User Accounts and Responsibilities

All content on housebyintent.com, including but not limited to text, graphics, logos, images, articles, design guides, case studies, and software, is the property of House by Intent, Blake Donovan, or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
The House by Intent name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Blake Donovan and Donovan Smart Living. You may not use these marks without our prior written permission.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. This license does not include any right to: (a) resell or make commercial use of the Service or its content; (b) modify, reproduce, or create derivative works based on the Service or its content; (c) download or copy content for the benefit of another party; or (d) use any data mining, robots, or similar data gathering or extraction methods.
6. User Content and Submissions
House by Intent may allow you to submit comments, questions, feedback, suggestions, or other content ("User Content"). By submitting User Content to housebyintent.com, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.
You represent and warrant that: (a) you own or control all rights to your User Content; (b) your User Content is accurate and not misleading; (c) your User Content does not violate these Terms or any applicable law; and (d) your User Content will not cause injury to any person or entity.
We reserve the right, but are not obligated, to monitor, edit, or remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. We do not endorse any User Content or any opinion, recommendation, or advice expressed therein.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. HOUSE BY INTENT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
House by Intent does not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. We make no warranties about the accuracy, reliability, completeness, or timeliness of the content, services, software, or graphics provided through the Service.

While our insights are drawn from over 200 Los Angeles projects, every home and situation is unique. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOUSE BY INTENT, BLAKE DONOVAN, DONOVAN SMART LIVING, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
Your access to or use of or inability to access or use the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF HOUSE BY INTENT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICE GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
9. Indemnification
You agree to defend, indemnify, and hold harmless House by Intent, Blake Donovan, Donovan Smart Living, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

10. Termination
We reserve the right to suspend or terminate your access to the Service, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service will immediately cease.

All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.
You and House by Intent agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
12. Changes to Terms
House by Intent reserves the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on housebyintent.com and updating the "Last Updated" date at the top of this page. We may also notify you via email or through a notice on our website.
Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions herein.
14. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by House by Intent on the Service, constitute the entire agreement between you and House by Intent concerning the Service and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
